Abstract

La guérison est un événement qui dépasse toujours les formes culturelles et religieuses autant que les pratiques médicales qui voudraient en rendre compte. Elle ne peut jamais s'expliquer uniquement comme le résultat d'une croyance, d'une foi ou d'une quelconque technique, qu'elle soit rituelle ou scientifique. L'auteur revient sur la figure du Christ médecin et du Christ malade et sur la diversité irréductible des expériences : miracles, onction des malades, exorcismes. Le pouvoir comme le devoir de guérir y apparaissent toujours supérieurs à la loi. La guérison est comme une langue étrangère, un je-ne-sais-quoi qui rejoint le secret de la vie. L'approche de questions difficiles, comme celle de l'euthanasie, en sortira renouvelée.

Abstract

In the last decade health care has witnessed a host of technological novelties in the field of diagnostic and therapeutic practices, as well as in the supportive information and communication technology and in various applications of genetics, microbiology and informatics. As a result a few questions need to be answered: -Is health care ethics due dor a splitting up into an ethics of technology (focusing on the ethical implications of new technologies) and an ethics of care (focusing on the ethical problems concerning chronic diseases, decay, disability, end of life)? -How to cope with dependence, limitation, finiteness, suffering, ... in spite of technological progress? -Could a better integration of technology and care preclude situations where patients are being dehumanised? Starting with a philosophical ethical reflection about the possibilities and dangers of technologies in health care, this book highlights both the relation between technology and care, and the normative aspects of economic analyses in health care. Finally, a series of concrete examples from various clinical fields (prenatal diagnosis, genetic tests, digital imaging in psychiatry, tube feeding in care for the elderly, and palliative sedation) will help the authors to consider how to integrate these technologies in a care context aimed upon humaneness. Since each topic is analysed by leading European clinicians and health care ethicists, this book clearly stands for the interdisciplinary approach in health care ethics. This book may be a rich source of material for reflection on the role, meaning and ends of technology and care, as harmonious aspects of clinical health care practice. However, the authors main concern is to show what such a reflection may consist of and how it can contribute to the inquiry into the experience of technology, the needs of humanity and the development of appropriate health care. This book highlights both the relation between technology and care, and the normative aspects of economic analyses in health care. A series of concrete examples from various clinical fields (prenatal diagnosis, genetic tests, digital imaging in psychiatry, tube feeding in care for the elderly, and palliative sedation) helps the authors to consider how to integrate these technologies in a care context aimed upon humaneness. Each topic is analysed by leading European clinicians and health care ethicists.

Abstract

Abstract

La génétique est sous les feux de la rampe depuis plusieurs années. Avec la génétique humaine et le développement des tests, c'est la médecine prédictive qui acquiert ses lettres de noblesse. Une impulsion nouvelle est donnée au projet de remplacer progressivement une médecine curative ou palliative par une médecine active de prévention des maladies. Mais si le savoir génétique apporté par le résultat d'un test nous donne une connaissance anticipée de notre avenir organique probable - ou de celui de l'enfant que nous attendons - force est de reconnaître qu'actuellement notre capacité d'intervention pour en infléchir le cours reste très limitée. Que faire alors de tout ce savoir prédictif dans le domaine de la santé et de la procréation ? Dans une première partie, cet ouvrage aborde des questions qui émergent dans la presse, les publications et les colloques à propos des tests diagnostiques et prédictifs de santé : complexité du conseil génétique, évaluation des risques et risque zéro, eugénisme social, relation médecin-malade, régulations personnelle et sociale de l'usage des tests, etc. Dans une seconde partie, il approfondit d'un point de vue éthique et philosophique certaines questions qui paraissent centrales pour aborder le problème d'une meilleure «humanisation» des tests : statut de la connaissance objective face à l'engagement et à la responsabilité pour l'autre dans la situation du diagnostic anténatal et statut du savoir prédictif face à l'interprétation en terme de «destin» ou de «liberté» pour l'ensemble des tests. La liberté de l'homme - qu'il soit adulte ou en gestation - ne serait-elle pas d'attester qu'il peut être en excès sur tout savoir porté sur lui et qu'en aucun cas un gène, quel qu'il soit, ne peut être interprété comme l'écriture de son destin ?

Abstract

By reviving the age-old concern of humanisation of medicine, these hospital ethics committees might be capable of initiating an in-depth transformation of medical practice. The Ethical Function in Hospital Ethics Committees project aimed to observe and record the reality happening in these structures and what potential they hold. The book includes an overview of the situation of hospital ethics committees in the different European countries involved in the network, a set of contributions that address more specific issues that have been discussed during three international workshops and finally recommendations about possible organizational and/or legal measures to be taken in order to stimulate the practical involvement of ethics in hospital practice at a European level. Everybody interested or sensitive to the development of ethics reflection in hospital should benefit from the information in this book, healthcare practitionners, philosophers, sociologists as well as policy makers and ... citizens. This book was written to present the results of the concerted action called Ethical Function in Hospital Ethics Committees funded by the European Union in the context of the BIOMED II programme. Ethics committees as a principle - national, clinical or for research - do appear as quite innovative in the hospital environment. They offer an opportunity, deep in the clinical practice, to think about wide and subtle issues of medicine, throughout a variety of discourses coming from philosophy, social sciences, law, and laymen as well. Some people consider these committees as a useless complication in medical decision process, which adds a further institutionalized structure in an area where bureaucracy is already overwhelming. Other people, however, hope that they will contribute to open a public realm where science in action might be a matter of concern and reflections. This would guarantee that the discussion about medical and particularly hospital problems should take into account the point of view of the patients in its full and human dimension.
